California’s Law on Punitive Damages. California’s law on punitive damages, also known as exemplary damages, is stated in California Civil Code Section 3294. The code states that punitive damages can only be awarded when the defendant is proven guilty of oppression, fraud, or malice with clear and convincing evidence.

Punitive damages, or exemplary damages, are damages assessed in order to punish the defendant for outrageous conduct and/or to reform or deter the defendant and others from engaging in conduct similar to that which formed the basis of the lawsuit. Punitive damages are monetary damages awarded to a plaintiff when the law says the defendant should be punished. When Punitive Damages are Available .
